Privacy policy
1. Who is responsible for your data
The controller for personal data processed through this website and our services is AeLux Holding Pte. Ltd., trading as Salesfinch Studio, 68 Circular Road, #02-01, Singapore 049422, UEN 202323447K ("we", "us").
Because we offer our services to businesses in the European Union, the EU General Data Protection Regulation (GDPR) applies to our processing of personal data of people in the EU (Art. 3(2) GDPR). As a Singapore company, we also comply with the Singapore Personal Data Protection Act 2012 (PDPA). For all privacy questions and requests, write to hello@salesfinch.com.
2. What we process, why, and on what legal basis
Visiting this website. When you load a page, our hosting provider processes your IP address, browser and device information, the page requested and the time of the request, to deliver the website and protect it against attacks. Legal basis: our legitimate interest in operating a secure, working website (Art. 6(1)(f) GDPR). We do not keep our own access logs and we do not use analytics or advertising cookies on this website.
Newsletter. If you subscribe, we process your email address, the time you signed up, the page you signed up on and the wording of the consent you gave, to send you our newsletter. Legal basis: your consent (Art. 6(1)(a) GDPR). You can withdraw your consent at any time with the unsubscribe link in every newsletter or by email, without affecting earlier processing. We keep your address until you unsubscribe and then delete it, except for a record that you opted out. New subscribers receive a one-time code for 10% off their first month on any plan.
Enquiries and calls. When you contact us or book a call, we process your name, company, email address, phone number (if you give it) and your message, to reply, prepare an offer and follow up. Legal basis: our legitimate interest in answering business enquiries (Art. 6(1)(f)) or steps prior to a contract (Art. 6(1)(b)).
Client work. We process contact details of the people we work with, brand materials, images and clips you provide, monthly call notes, content plans, feedback and correspondence, to deliver the service. Where you give us access to your social media accounts, we use it only through the platform's official partner or team roles, or through a scheduling tool you connect, and only to publish content you have approved. Legal basis: performance of our contract (Art. 6(1)(b)) where you are our contracting party, otherwise our legitimate interest in performing the contract with your company (Art. 6(1)(f)).
Payments and accounting. When you pay online, Stripe processes your payment. We receive confirmation of the payment, your name, email address, billing details and the amount; we never see full card numbers. We keep invoices and payment records to meet tax and company law obligations (Art. 6(1)(c)).
Our social media profiles. This website links to our profiles. These are plain links: no data is sent to the platforms until you click one. Once you are on a platform, its own privacy policy applies.
Providing your data is not a legal requirement, but we cannot answer an enquiry or carry out a project without the details needed for it. We do not make decisions about you based solely on automated processing.
3. Who receives your data
We do not sell personal data. We share it only with the following service providers, and with professional advisers or authorities where the law requires.
- Cloudflare, Inc. (USA): website hosting, content delivery and security. Processor. Transfer basis: EU-U.S. Data Privacy Framework, with Standard Contractual Clauses as a fallback.
- HubSpot (HubSpot, Inc. and its affiliates): newsletter, contact forms, booking calls and customer relationship management. Processor. Transfer basis: EU-U.S. Data Privacy Framework and Standard Contractual Clauses.
- Stripe Payments Europe, Limited (Dublin, Ireland): payment processing. Stripe acts as our processor for payment data and as an independent controller for its own purposes, such as fraud prevention and legal compliance. Transfers to the USA: EU-U.S. Data Privacy Framework and Standard Contractual Clauses.
- Anthropic (Claude): AI tool used in content production, for example to draft captions and content plans from your materials. Processor. Transfer basis: Standard Contractual Clauses.
- Google (Google Ireland Limited and Google LLC): business email, including confirmation emails after you contact us or subscribe, and video calls via Google Meet. Processor. Transfer basis: EU-U.S. Data Privacy Framework and Standard Contractual Clauses.
4. Transfers outside the EU
Several providers above are based in, or access data from, countries outside the European Economic Area. For the USA we rely on the EU-U.S. Data Privacy Framework where the recipient is certified, and otherwise on Standard Contractual Clauses adopted by the European Commission. As a Singapore company, we also work with your data in Singapore ourselves. Singapore does not have an EU adequacy decision; our processing there is subject to the GDPR as described in this policy and to the PDPA. You can request a copy of the safeguards for any transfer by email.
5. How long we keep data
- Enquiries that do not lead to a project: up to 24 months after our last contact.
- Project data and correspondence: for the duration of the relationship and up to 24 months afterwards, unless needed longer to establish or defend legal claims.
- Invoices and accounting records: for the periods required by applicable tax and company law.
- Newsletter subscriptions: until you unsubscribe.
6. Your rights
You have the right to access your personal data, to have it corrected or erased, to restrict its processing, to data portability, and to object to processing based on our legitimate interests, including at any time to direct marketing. Where processing is based on consent, you can withdraw it at any time, without affecting the lawfulness of processing before the withdrawal. To exercise your rights, write to hello@salesfinch.com; we will respond within one month.
You also have the right to lodge a complaint with a supervisory authority, in particular in the EU country where you live, work or where the alleged infringement took place, for example the Data Protection Commission in Ireland (www.dataprotection.ie). In Singapore, the supervisory authority is the Personal Data Protection Commission (www.pdpc.gov.sg).
7. Security and changes
We protect personal data with appropriate technical and organisational measures, including encrypted connections and access controls. We may update this policy; the date at the top shows the latest version.
Terms of service
1. Who we are and who these terms are for
These terms apply to all services provided by AeLux Holding Pte. Ltd., trading as Salesfinch Studio ("Salesfinch Studio", "we", "us"), to our clients ("you"). Our services are offered only to businesses. By ordering, you confirm that you are acting for business purposes and are authorised to bind your company.
2. Services and how a contract is made
We plan, create and, where your plan includes it, schedule social media content such as posts, carousels, short videos, captions and content calendars, as described on this website, in the order or in a written proposal. A contract is made when you complete an online payment for a plan or trial pack, or when you accept a written proposal in writing (email is sufficient). If a proposal and these terms differ, the proposal applies.
3. Prices and payment
Prices are in euro and exclude VAT, which is added where applicable. The trial pack is paid in full in advance. Monthly plans are billed monthly in advance through Stripe and renew automatically each month until cancelled. Late payments bear interest at the rate under the European Communities (Late Payment in Commercial Transactions) Regulations 2012, and we may claim the fixed compensation for recovery costs under those Regulations. We may pause work while a payment is overdue. Promotional discounts, such as a founding client or newsletter discount, apply only as stated in the offer.
4. Your brand, materials and approvals
You provide your brand assets (logo, colours, fonts, website), images and clips, and the information needed for the content. Timelines start when we have these materials. You confirm that you have the rights to everything you supply, including the consent of people shown in images and clips, and you allow us to use it for your content. We only use images you have approved.
Each month you approve the content plan, and you approve content before it is published. You are responsible for checking factual statements, offers, advertising claims, trade marks and any rules that apply to your industry or market before you approve.
5. Style, delivery and revisions
Once you have chosen a style, it is fixed for the following content. The monthly topic plan can be adjusted once; after that it is locked. Your plan includes the number of revision rounds shown on this website. A revision round is one consolidated set of feedback on finished pieces. A change of style or topics after approval is new work and may be charged separately. If we receive no feedback within 7 days of delivering content, it is treated as approved for publishing.
6. Access to your accounts
We never ask for your passwords. Where your plan includes scheduling, you give us access through the platform's official partner or team roles, or by connecting your accounts to a scheduling tool. Your accounts remain yours, and you can remove our access at any time. We publish only content you have approved. Social media platforms set and change their own rules and may limit, restrict or remove content or accounts; we are not responsible for their decisions, and we do not guarantee reach, followers, leads or sales.
7. Cancellation and refunds
Monthly plans can be cancelled at any time, effective at the end of the current billing month. There is no refund for the month in progress. The trial pack is not refundable once work has started; if you are not happy with it, we revise it once free of charge. If you cancel before we begin work, we refund the full amount paid.
8. Rights in the work
Once we have received full payment, we assign to you all copyright that we own in the final content delivered to you, so you can use it for any purpose. Your own materials remain yours. Third-party material, such as licensed fonts, music or stock media, is used under its own licence. Drafts and unused versions remain ours, but we will not reuse them for another client in a recognisable form. We may show published content in our portfolio unless we agree otherwise in writing.
9. AI-assisted production
Our production is AI-assisted. Planning, creative direction, selection and final review are carried out by people at Salesfinch Studio. We use AI tools only under terms that permit commercial use of their output. The law on copyright in AI-generated material is still developing and differs between countries; the assignment in section 8 covers the rights that exist and that we own. Where content contains realistic AI-generated or AI-altered images, video or audio of people, places or events, we will tell you and supply a suitable disclosure text, which you keep when you publish where the EU AI Act or other law requires it. We do not create content that imitates a real, identifiable person without that person's documented consent.
10. Our commitments and liability
We perform our services with reasonable skill and care. Beyond the commitments in these terms, we give no further warranties. Our total liability under or in connection with an order is limited to the fees paid for that order; for monthly plans, to the fees paid in the 12 months before the claim arose. We are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
11. Termination for breach
Either party may terminate by written notice if the other materially breaches these terms and does not remedy the breach within 14 days of being asked to. Fees for work already performed remain payable.
12. Confidentiality
Each party keeps the other's non-public information confidential and uses it only for the services. This does not apply to information that is public, or that must be disclosed by law.
13. Data protection
Each party is responsible for the personal data of its own staff and contacts. Where we process personal data on your behalf as part of the services (for example images of people or customer data you provide), we act as your processor and we: process it only on your documented instructions; ensure that everyone handling it is bound by confidentiality; apply appropriate security measures; use sub-processors only with your general authorisation and under equivalent obligations, informing you of changes; assist you with data subject requests and with your obligations on security, breach notification and impact assessments; delete or return the data at the end of the services; and make available the information needed to demonstrate compliance, including allowing audits.
14. Events outside our control
Neither party is liable for delay or failure caused by events beyond its reasonable control, including outages or changes of social media platforms. The affected party will inform the other promptly and resume performance as soon as possible.
15. Governing law and courts
These terms and any contract under them are governed by the laws of Ireland. The courts of Ireland have exclusive jurisdiction over any dispute arising from or in connection with them.
16. General
These terms, together with your order or proposal, are the entire agreement between us for the services. Changes must be agreed in writing (email is sufficient). We may update these terms for future orders and for monthly plans with at least 30 days' notice by email; you can cancel before the change takes effect. Notices may be sent by email.
